1. Acceptance of Terms

These Terms of Service (“Terms”) constitute a legally binding agreement between you and Dating AI Chat (“Company”, “we”, “us”, or “our”), operating at datingai.chat.

By accessing or using the Dating AI Chat platform, mobile applications, or any related services (collectively, the “Service”), you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use the Service.

2. Eligibility

You must be at least 18 years of age to use Dating AI Chat. By using the Service, you represent and warrant that:

• You are at least 18 years old.
• You have the legal capacity to enter into these Terms.
• Your use of the Service does not violate any applicable law or regulation in your jurisdiction.

We reserve the right to verify age and to suspend or terminate accounts of users who do not meet eligibility requirements. We take underage access extremely seriously and operate a zero-tolerance policy.

3. Accounts

3.1 Account Creation

The Service may be used without an account for basic features. If you create an account, you agree to provide accurate, current, and complete information and to keep it updated.

3.2 Account Security

You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. Notify us immediately at support@datingai.chat of any unauthorised access.

3.3 One Account per Person

Each user may maintain only one account. Creating multiple accounts to circumvent restrictions or bans is prohibited and may result in permanent suspension.

4. The Service

Dating AI Chat provides an AI-powered dating simulation and companion chat service. The AI companions are entirely fictional entities powered by language models. They are not real people and do not have genuine consciousness, emotions, or intentions.

We reserve the right to:

• Modify, suspend, or discontinue any aspect of the Service at any time.
• Update, change, or remove AI companions, features, or content.
• Set limits on usage, storage, or access to certain features.

5. User Conduct & Prohibited Uses

You agree to use the Service only for lawful purposes. You must not:

• Use the Service if you are under 18 years old.
• Attempt to extract, reverse-engineer, or replicate the AI models or underlying technology.
• Use automated scripts, bots, scrapers, or crawlers to access the Service.
• Generate, distribute, or attempt to use the Service to create content involving minors in any sexual context.
• Harass, threaten, or harm other users or our staff.
• Engage in any activity that violates applicable laws, including obscenity laws, data protection laws, or intellectual property laws.
• Attempt to circumvent security measures, access controls, or subscription restrictions.
• Misrepresent yourself or impersonate others.
• Use the Service for commercial purposes without our prior written consent.
• Share your account with others or sell access to the Service.

Violation of these prohibitions may result in immediate termination of your account and, where appropriate, referral to law enforcement authorities.

6. Content & Intellectual Property

6.1 Our Content

All content provided by Dating AI Chat - including AI companion personas, graphics, text, software, and trademarks - is owned by or licensed to us and is protected by applicable intellectual property laws. You may not copy, reproduce, or distribute our content without express written permission.

6.2 Your Content

You retain ownership of any content you provide to the Service. By submitting content, you grant us a limited, non-exclusive, royalty-free licence to use, process, and store such content solely for the purpose of providing and improving the Service.

6.3 AI-Generated Content

Content generated by our AI companions is provided for entertainment and personal use only. It should not be taken as professional advice (medical, legal, psychological, or otherwise). We make no warranties regarding the accuracy or appropriateness of AI-generated responses.

7. Adult Content (NSFW)

Dating AI Chat offers optional adult (NSFW) content features. By enabling this mode, you confirm that:

• You are at least 18 years old.
• Adult content is legal to access in your jurisdiction.
• You are accessing the content voluntarily for personal, private use.
• You will not share, distribute, or publish AI-generated adult content to any third party without our express written permission.

Any attempt to use the NSFW features in relation to minors, non-consensual scenarios involving real people, or any other illegal purpose is strictly prohibited and will result in immediate account termination and referral to authorities.

8. Payments & Subscriptions

8.1 Free Tier

A free tier is available with limited features. No payment is required to access basic Service functionality.

8.2 Premium Subscriptions

Premium features require a paid subscription. All prices are displayed in USD and are subject to applicable taxes. Subscriptions auto-renew unless cancelled.

8.3 Cancellation

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. No partial refunds are issued for unused time unless required by applicable law.

8.4 Refunds

Refund requests are evaluated on a case-by-case basis. Contact billing@datingai.chat within 7 days of a charge for assistance. We comply with all consumer protection laws in applicable jurisdictions.

8.5 Price Changes

We reserve the right to change subscription prices with at least 30 days' notice. Continued use after the effective date constitutes acceptance of the new pricing.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DATING AI CHAT AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) USD $100 OR (B) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify, defend, and hold harmless Dating AI Chat and its affiliates, officers, employees, and agents from any claims, liabilities, damages, costs, and expenses (including legal fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) your content.

12. Termination

We may suspend or terminate your access to the Service immediately and without notice if you violate these Terms, engage in prohibited conduct, or for any other reason at our sole discretion. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including sections on IP, disclaimers, liability, and indemnification) will survive.

13. Governing Law & Disputes

These Terms are governed by and construed in accordance with applicable laws. Any dispute arising from these Terms that cannot be resolved informally shall be submitted to binding arbitration, except where prohibited by law. Nothing in this section prevents you from bringing a claim to your local small claims court or consumer protection authority.

You waive the right to participate in class action lawsuits to the fullest extent permitted by law.

14. Changes to These Terms

We may update these Terms from time to time. Material changes will be notified via email (if you have an account) or by prominent notice on the Service. Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance.
